EPA, Aquila Find Resolutions for Wetlands Permit

Aquila Resources clears a major hurdle in the development of the Back Forty Mine. Last week the company announced the EPA confirmed to Michigan’s Department of Environmental Quality that a number of objections identified in Aquila’s Wetlands Permit application have been resolved. Aquila adds the EPA believes “there is a ready pathway for the resolution of the EPA’s remaining objections through MDEQ’s inclusion of specific conditions in a final Wetlands Permit.” Permit conditions must meet EPA standards by June 6th- a deadline Aquila says they’re confident they’ll meet. In January, the Menominee Indian Tribe filed a lawsuit against the EPA and the Army Corps of Engineers claiming the agencies failed to properly review the permit application. The Wetlands Permit is the final permit necessary to begin constructing and operating the Back Forty Mine.
