Lavigne Convicted of 3rd Degree Sexual Assault

09/20/2019- A guilty verdict is returned in the case of a former Little Chute teacher accused of sexually assaulting a teen during a trip to Marinette County last summer.
The jury deliberated for around five hours Thursday in the matter against 47-year-old Jason Lavigne of Appleton. During his closing statement Assistant District Attorney Cody Marschall directed the jury’s attention to what he cites as one of the most critical pieces of evidence in the case: the phone conversation between Lavigne and his daughter after his arrest where Lavigne directs her to tell police she saw the victim initiate the contact. Attorney Marschall says, despite claims by the defendant the victim was the instigator in this incident, the call is proof Lavigne knew he needed to create a cover story.
“This is consciousness of guilt. Mr. Lavigne knew he had to have his loose ends taken care of…His story had to make sense and his daughter’s story had to make sense. He wasn’t trying to comfort his daughter because she had to talk to the detective. He told her what to say.”
A sentencing date has not yet been set, but Lavigne is facing up to ten years in prison for the conviction of third-degree sexual assault. He’s currently serving a five-year prison sentence in Outagamie County for Repeated Sexual Assault of the Same Child from allegations that he had inappropriate contact with a student in 2000
